traffic law

In traffic law cases it often happens that many different fields of law are intertwined.

One traffic accident can lead to a criminal investigation, to problems with the Federal Motor Transport Authority, civil suits for compensation and conflicts with insurance companies.

 The consequences of hasty actions or statements (see freedom from self-incrimination) are very difficult to assess for laypeople. That‘s why it is a good idea to let a lawyer advise and legally represent you as soon as possible.

For a traffic offence, like when you are accused of speeding because of a radar trap photo, it is imperative for an effective defense to request insight into the official files. Only then can potential points of attack against the case like a formally deficient speed measurement be identified.

 If a case is only about small fines, and your driver‘s licence isn‘t affected, a legal dispute may often not be worth it without having a legal expense insurance.

regulatory offences

Offences against regulatory law (i.e. the trade regulations act or the act to combat undeclared work and unlawful employment) can lead to financial fines.

It‘s often a good idea to get advice from a lawyer in these cases, especially if the fine is substantial.

consumer law

Consumer law deals with claims of consumers against businesses. § 13 BGB (German Civil Code) gives a legal definition of what a“consumer“ is:

 „A consumer means every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession.“

 So consumers are human beings who buy, rent or order something as a private person. This means that almost every human being is constantly acting as a consumer.

 Opposite to the consumer stands the „entrepreneur“, who is defined in § 14 BGB:  „An entrepreneur means a natural or legal person or a partnership with legal personality who or which, when entering into a legal transaction, acts in exercise of his or its trade, business or profession.“

 Examples for entrepreneurs are online retailers, rental car companies, airlines or energy utility companies.

 

Most people from time to time feel like they are being mistreated by a business they bought, rented or ordered something from. Often they feel powerless about this, especially when dealing with large corporations.

Fortunately the EU has passed a number of consumer rights directives that give consumers opportunities to legally fight back in these situations, especially if they are represented by a competent attorney.

Civil law and contract law

Civil law deals with legal relationships between different (natural or legal) persons. That is why it is also called private law.

 When two persons argue about whether one owes the other something (like money for example), they argue about civil law.

 Particularly important in civil law are contracts. Contracts always contain a lot of legal terms that are often misinterpreted by laypeople.

Therefore it is often a good idea to get advice from a lawyer before you enter a contract. The attorney can then tell you about the content of the contract or even draft the contract himself.

 A lawyer can also advise you on whether or not you have a legal claim against someone else because of an existing contract or vice versa. If legal steps are necessary, your lawyer can initiate those as well.
